Distance Selling Terms

These Terms of Sale apply to purchases made through www.coffeecalibre.com by customers located outside Türkiye, including customers located in the European Union and the European Economic Area, unless otherwise stated.

By placing an order on our website, you confirm that you have read, understood, and accepted these Terms of Sale. You also acknowledge that, once your order is confirmed, you are under an obligation to pay the total amount of the order, including the product price, shipping fees, taxes, duties, and any other applicable charges shown during checkout.

2. Customer Information

The customer is the natural or legal person who places an order through our website.

The customer information, delivery address, billing address, contact details, and order details are provided by the customer during the checkout process. The customer is responsible for ensuring that all information submitted during checkout is accurate, complete, and up to date.

3. Scope of These Terms

These Terms of Sale govern the sale and delivery of products purchased through our website.

These Terms apply to the purchase of goods offered by Calibre Kahve A.Ş., including but not limited to coffee products, coffee equipment, accessories, gift sets, and other products listed on our website.

These Terms do not apply to transactions that are not completed through our website or to services and products governed by separate written agreements.

4. Product Information

The main characteristics of each product are provided on the relevant product page. These may include the product name, origin, variety, processing method, tasting notes, weight, quantity, packaging details, usage information, and any other relevant product description.

We make reasonable efforts to ensure that product information, images, descriptions, prices, and availability are accurate. However, minor variations may occur, especially in relation to product images, packaging, color tones, and tasting descriptions.

For coffee products, tasting notes are descriptive and may vary depending on brewing method, water quality, grind size, recipe, equipment, and personal perception.

5. Prices, Taxes, and Charges

All product prices are displayed on our website. The total order amount, including product price, shipping fees, and any applicable taxes or charges, will be shown during checkout before the order is confirmed.

For international orders, additional customs duties, import taxes, local VAT, customs clearance fees, or other charges may apply depending on the destination country. Unless expressly stated otherwise during checkout, such charges are the responsibility of the customer.

Prices may be updated from time to time. The price applicable to your order is the price displayed at the time you place your order.

Promotional prices, discount codes, campaigns, and special offers are valid only under the conditions and time periods stated on our website.

6. Order Placement and Contract Formation

To place an order, the customer selects the relevant products, adds them to the cart, enters the required delivery and billing information, selects a payment method, reviews the order summary, and confirms the order.

Before confirming the order, the customer has the opportunity to review and correct the information entered.

A contract is formed between the customer and Calibre Kahve A.Ş. when the order is placed and payment is successfully completed or authorized.

After the order is placed, an order confirmation may be sent to the email address provided by the customer. This confirmation includes the order details and does not affect any legal rights the customer may have.

We reserve the right to reject or cancel an order where payment is not completed, product availability is limited, incorrect information has been provided, fraud or misuse is suspected, or fulfillment is not reasonably possible.

7. Payment

Payment methods accepted on our website are shown during checkout.

The customer undertakes to pay the full order amount, including product price, shipping costs, taxes, duties, and any other applicable charges shown during checkout.

Payments are processed through secure payment service providers. We do not directly store full credit card information.

If payment is not successfully completed or is later cancelled, reversed, or refused by the payment provider or issuing bank, we may suspend or cancel the order.

8. Delivery

Products are delivered to the delivery address provided by the customer during checkout.

Estimated delivery times, shipping methods, and shipping fees are shown during checkout or on the relevant delivery information pages of our website.

Unless otherwise agreed, we aim to deliver the products within the estimated delivery period. For customers located in the European Union, where applicable consumer law provides a default delivery period, goods should generally be delivered within 30 days unless a different delivery time has been agreed.

Delivery times may vary depending on destination, customs procedures, carrier operations, public holidays, force majeure events, or circumstances beyond our reasonable control.

The customer is responsible for providing a complete and accurate delivery address. We are not responsible for failed or delayed delivery caused by incorrect, incomplete, or outdated delivery information provided by the customer.

9. Customs and Import Responsibilities

For international deliveries, the customer may be required to comply with local customs rules and import regulations.

The customer is responsible for checking whether the ordered products may be lawfully imported into the destination country.

Any customs duties, import taxes, local VAT, customs clearance fees, storage fees, brokerage fees, or similar charges imposed by the destination country are the responsibility of the customer, unless expressly stated otherwise during checkout.

If a shipment is refused, returned, delayed, destroyed, or confiscated due to customs rules, import restrictions, unpaid customs charges, or the customer’s failure to provide required information, we may deduct related costs from any refund to the extent permitted by applicable law.

10. Inspection Upon Delivery

The customer should inspect the package upon delivery.

If the package appears damaged, opened, wet, torn, crushed, or otherwise compromised, the customer should, where possible, report this to the carrier at the time of delivery and contact us as soon as possible.

If the product received is defective, damaged, incorrect, or incomplete, the customer should contact us at info@coffeecalibre.com with the order number, a description of the issue, and, where possible, photographs of the product and packaging.

This section does not limit any mandatory consumer rights that may apply under applicable law.

11. Right of Withdrawal

If you are a consumer located in the European Union or European Economic Area, you may have the right to withdraw from a distance contract within 14 days without giving any reason, unless an exception applies.

For goods, the withdrawal period generally expires 14 days after the day on which you, or a third party indicated by you other than the carrier, receives the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by a clear statement, such as an email sent to info@coffeecalibre.com.

You may use the model withdrawal form provided at the end of these Terms, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your withdrawal notice before the withdrawal period has expired.

12. Effects of Withdrawal

If you withdraw from the contract in accordance with these Terms and applicable law, we will reimburse the eligible payments received from you, including the standard delivery cost where required by law.

We may withhold reimbursement until we have received the returned goods or until you have provided evidence that you have sent the goods back, whichever occurs first.

Refunds will be made using the same means of payment used for the original transaction, unless otherwise agreed.

The customer must send the goods back without undue delay and in any event no later than 14 days from the day on which the customer informs us of the withdrawal.

Unless otherwise required by applicable law or unless the product is faulty or incorrect, the customer may be responsible for the direct cost of returning the goods.

The customer is responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

13. Exceptions to the Right of Withdrawal

The right of withdrawal may not apply to certain products, including but not limited to:

Products made to the customer’s specifications or clearly personalized products.

Products that are liable to deteriorate or expire rapidly.

Sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

Goods which, after delivery, are inseparably mixed with other items.

Digital content or services that have been supplied immediately with the customer’s prior consent, where the right of withdrawal has been waived in accordance with applicable law.

Due to the nature of coffee as a food product, opened coffee packages may not be suitable for return for health, hygiene, and product safety reasons. This does not affect your legal rights if the product is defective, damaged, incorrect, or not as described.

14. Returns

Products to be returned must be sent to the return address communicated by us after the customer contacts info@coffeecalibre.com.

Returned products should be sent with their original packaging, accessories, labels, invoices, and any standard items delivered with the product, where applicable.

The customer should package the returned products securely to prevent damage during return shipment.

We recommend using a trackable shipping method for returns. We are not responsible for returned goods lost or damaged in transit, unless otherwise required by applicable law.

15. Defective, Damaged, or Incorrect Products

If you receive a defective, damaged, incorrect, or incomplete product, please contact us at info@coffeecalibre.com as soon as possible.

Your message should include your order number, a description of the issue, and photographs of the product and packaging where possible.

Where required by applicable consumer law, we may offer repair, replacement, price reduction, refund, or another appropriate remedy depending on the circumstances.

Nothing in these Terms limits your mandatory legal rights regarding faulty or non-conforming goods.

16. Promotions, Discount Codes, and Campaigns

Promotions, discount codes, gift offers, free shipping campaigns, and similar benefits are valid only under the specific conditions stated on our website or in the relevant campaign communication.

Discount codes may be subject to minimum order amounts, product exclusions, expiration dates, usage limits, regional restrictions, or other conditions.

If an order is returned or cancelled, the promotional benefit may be recalculated or cancelled where permitted by law.

17. Customer Obligations

The customer agrees to provide accurate, complete, and up-to-date information during checkout.

The customer must not use the website for unlawful purposes, fraudulent transactions, unauthorized access, interference with the website, or any activity that may harm Calibre Kahve A.Ş., other users, or third parties.

The customer is responsible for ensuring that the ordered products are suitable for their intended use and may be lawfully imported into and used in the destination country.

We are not responsible for failure or delay in performing our obligations where such failure or delay is caused by events beyond our reasonable control.

Such events may include natural disasters, extreme weather, war, terrorism, civil unrest, strikes, pandemics, governmental restrictions, customs delays, carrier disruptions, technical failures, supply shortages, or other events that could not reasonably have been foreseen or prevented.

If such an event affects the fulfillment of your order, we will inform you as soon as reasonably possible.

These Terms are governed by the laws of Türkiye, unless mandatory consumer protection rules in your country of residence provide otherwise.

If you are a consumer located in the European Union or European Economic Area, you may benefit from the mandatory consumer protection rules of your country of residence.

Nothing in these Terms limits any mandatory rights you may have under applicable consumer protection laws.

We may update these Terms of Sale from time to time. The updated version will become effective once published on our website.

The Terms applicable to your order are the Terms in force at the time your order is placed.

23. Model Withdrawal Form

You may use this form if you wish to withdraw from the contract, but it is not mandatory.
